Description

The Clerk of Orphans’ Court office staff performs the duties of the Orphans’ Court as defined in Title 42 of PA Consolidated Statutes.  Title 42 deals with the judiciary and judicial procedure.  It provides that all matters to be heard or determined in the Orphans’ Court division of the Court of Common Pleas are filed in the Clerk of Orphans’ Court.  The Clerk of Orphans’ Court has the specific authority to act as an Officer of the Court.  As an Officer of the Court, the Clerk of Orphans’ Court is a Judicial Officer.  Also, the Clerk of Orphans’ Court has authority to perform the duties under Title 23 Domestic Relations Code.  The Clerk of Orphans’ Court is an integral part of the Commonwealth’s Unified Judicial System.

 

Bilingual 2nd Deputy Clerk of Orphans’ Court:  This Clerk will be trained in all facets of the PA Supreme Court Orphan’s Court Rules with regard to receiving, processing, indexing and filing a multitude of Register/Clerk legal documents along with Title 42 Domestic Relations Statute, as well as the Title 20 Probate, Estate and Fiduciaries Code.  This Clerk is responsible for processing all applicable documents related to the following legal issues to include but not limited to: Petitions for Adjudication of Incapacities, Guardians of a Minor, Wrongful Death, Releases, Family Settlement Agreements, Answers, Claims, Objections, Disclaimers, Power of Attorneys, Settlement of Small Estate, Subpoenas, and miscellaneous filings, interviewing marriage applicants and issuance of marriage license, and issue certified copies of marriage licenses.  In addition, processing any other legal documents that would be deemed necessary or appropriate under the statutes for the Clerk of Orphans’ Court to perform the Judicial Duties of the office.  Cross-trained in the Register of Wills to determine the validity of Wills and Codicils and the Granting of Letters to a Personal Representative, Issuing Oaths, Verifying Subscribing/Non-Subscribing Witnesses, Bond requirements, Self-Proving Affidavit.

 

Appointed by the court to be the true and lawful 2nd Deputy of the Clerk of Orphans’ Court of the York County Court of Common Pleas to act as fully and completely in the premises as the Clerk of Orphans’ Court in performing his duties.

General Requirements & Skills

  • Bilingual; assist Spanish-speaking members of the public through interpretation and assistance
  • High School Diploma required – Paralegal certificate or Associate’s Degree, primarily in Paralegal studies, preferred
  • Must be a team player and be able to work closely with a co-worker
  • Must possess excellent communication skills including professional verbal and written communications Ability to understand and apply Title 42 Domestic Relations Statute
  • Must possess knowledge of operation of personal computers, to include Microsoft Word, Outlook, case management database software, and other general office equipment
  • Must possess accurate computer and data entry skills
  • Ability to understand and apply PA Supreme Court Orphans’ Court Rules and Title 20 Probate, Estate and Fiduciaries Code
  • Ability to understand the PA Inheritance and Estate Tax.
  • Responsible for excellent customer service. Greets and assists customers at counter, on telephone, and on virtual meetings.
  • Responsible for working respectfully with both attorneys and non-attorney customers.
  • Responsible for interviewing marriage license applicants and issuing the license per Domestic Relations Code Title 23.
  • Processes marriage certificates; researches and issues certified copies of marriage licenses.
  • Collects fees per Order of Court 42 P.S. Section 21032.1 and posts to correct account.
  • Accepts and processes documents and petitions for Orphans’ Court.
  • Provides information to clients on the procedure to obtain birth and death records.
  • Processes and distributes U.S. mail and interoffice mail to coworkers.
  • Processes mail in Orphans’ Court, i.e. petitions filed with the Court, releases, family settlements, motions, and certified copies of marriage licenses.
  • Processes Small Estates after audit on behalf of Orphans’ Court.
  • Processes inheritance tax assessments and documents from PA Dept. of Revenue.
  • Assists with scanning Orphans’ Court daily work and backup for Register of Wills scanning.
  • Prepares and maintains file folders for Orphans’ Court and Adoptions; files file folders.
  • Assists in reconciling daily report and daily deposit when needed.
  • Participates in office cross training with Register of Wills office procedures.
  • Works in other positions as needed; other reasonable duties as assigned by supervisor.
